The Clerk's Office for the Juvenile & Domestic Relations District Court is located at 909 Court Street 1st Level, Lynchburg, VA 24504. Office hours are 8:00 a.m. to 4:00 p.m. The telephone number is 434-455-2670 and the fax number is 434-847-1442.
The Clerk's Office processes all casepapers that are filed with the court, keeps the records of the court and provides information to parties involved in cases in this court. The Clerk's Office can not give any legal advice.
General Information
Juvenile Traffic Pre-Payments
Juvenile traffic tickets that are pre-payable can be paid by mail or at the clerk's office window before the day of trial. You may call the Clerk's Office to obtain the correct amount to be paid. The juvenile must sign the waiver of appearance (yellow copy juvenile is given by police officer) and the parent's signature must be notarized.
Custody/Visitation Filings
Custody/visitation determinations are made in the J&DR District Court. If you do not already have an order from another court you may file a petition requesting custody or visitation in the court service unit located on the second floor of our building (telephone number: 455-2660). If you do have an order through this court granting you custody or visitation and wish to amend or change that order you may file a motion to amend at the clerk's office window.
Support Filings
Support determinations can be made in the J&DR District Court. If you do not already have an order from another court you may file a support petition in the court service unit located on the second floor of our building (telephone number 455-2660). If you already have an order through this court ordering support and you wish to amend or change that order you may file a motion to amend at the clerk's office window.
Court Dates
At the time of filing your petiton or motion the matter is stamped in with the date filed. The matter is then given to the person within the clerk's office that sets the matters on the court's docket for hearing by the judge. All matters filed are set according to time filed. It may be 4-6 weeks before you receive a court date. The sheriff's department in the jurisdiction where you reside will serve you with a summons to appear in court.
Subpoena Duces Tecums
A Subpoena Duces Tecum orders a person to produce at the time of hearing of your case any records in his possession that is relating to the issues pending in court. You may file a Subpoena Duces Tecum with the Clerk's Office. You will need to fill out the form and certify that you will send a copy of the Subpoena to the party you are requesting records from. The Subpoena Duces Tecum should be filed at least 15 days prior to your court hearing.
Subpoena For Witness
You have the right to subpoena any witnessess on your behalf. You may do this by filing a request for witness in the Clerk's Office. This must be done at least 10 days prior to your court hearing. The Clerk's Office will issue subpoenas to be served by the sheriff's department to have your witnesses come to court on your behalf.
Copys Of Court Orders
The Clerk's Office will make certified copies of your court orders for the following charge: first two pages $1.00, each additional page .50.
Appeals
All parties subject to a court order or judgement may appeal the decision of the J&DR court. The appeal will be held in the circuit court. Appeals must be noted within 10 days of your hearing in this court. The case will be heard all over again in circuit court.
